Upper Darby Township solicitor Sean Kilkenny has resigned, according to a statement from the Township, ending a contentious relationship between the attorney and the many Upper Darby residents attending Council meetings to criticize him.

Many residents have attributed recent difficulties the government has faced to poor legal advice by Kilkenny.

Late last year, the Council failed to pass a 2025 budget on time after a district court ruled Council had not followed proper procedures when it approved an income tax on Nov. 20, leaving the council with insufficient time to adopt an amended budget without the income tax.

In December of last year, the township withdrew an appeal to the Pennsylvania Supreme Court concerning the allocation of ARPA funding for the proposed Upper Darby Arts and Education Foundation (UDAEF) Cultural Arts Center at Barclay Square.

In the statement, Mayor Ed Brown thanked Kilkenny for his years of service to the Township.

“On January 6, 2025, the Upper Darby Administration and Council received a letter of resignation from Sean Kilkenny of Kilkenny Law, who has served as the Solicitor for Upper Darby Township,” the statement read.

“We extend our gratitude to Mr. Kilkenny and his firm for their five years of dedicated service to the Township. We appreciate his commitment to ensuring a smooth and professional transition during this process."
